Thailand says five Uyghur men can contest extradition in court; two tell rights commission they will not go.Thailand will let five detained Uyghur men challenge “a Chinese extradition request” in court before any deportation is approved, government spokesman Ekkapob Pianpises said Wednesday, Reuters reported; he said “the Thai government has granted them the right to contest the case” and that the two men nearest the end of their sentences “had been appointed a lawyer.” The Associated Press reported Thai officials saying China “must make a formal extradition request” if it wants the two men returned. Chaiyapruek Duangprapat, secretary-general of the National Security Council, said the courts would decide and that the other three men have about a year left to serve for a 2020 escape attempt; “if the court rules against them, they will be extradited according to the treaty,” he said, AP reported. The two men, aged 26 and 35, told the Office of the National Human Rights Commission on Wednesday that they do not want to be sent to China, AP reported, citing a person with direct knowledge of the meeting who was not named. They were moved from prison to Bangkok’s Suan Phlu immigration detention center on October 21 after a royal pardon and are represented by the Peace Rights Foundation, whose founder, former lawmaker Kannavee Suebsang, published their letter last week. Thai Foreign Ministry officials told a parliamentary committee that the Chinese Embassy demanded the men’s return in August, Human Rights Watch said. Thailand and China signed an extradition treaty in 1993, in force since 1999, Reuters reported. (Reuters, November 4; The Associated Press, November 4; Human Rights Watch, November 3)

INTERNATIONAL
Beijing invokes crime cooperation as Amnesty and Human Rights Watch demand the men not be returned. Asked about the case, Chinese Foreign Ministry spokeswoman Mao Ning said China and Thailand’s “cooperation in combating cross-border crimes, including illegal immigration” accords with both countries’ laws and international practice, AP and Reuters reported; she did not say whether China had sent an extradition request, and the ministry’s published transcript of Wednesday’s briefing does not include the exchange. Amnesty International, an advocacy group, said Wednesday that Thailand must give the men “access to a lawyer of their choice” and seek a third-country solution; its secretary general, Agnès Callamard, said “Thailand must not repeat last year’s unlawful deportation of 40 Uyghurs.” Human Rights Watch, an advocacy group, said Tuesday that Thailand should let the men travel to a safe third country and that Thai immigration authorities have repeatedly refused UNHCR access to assess their refugee status; its Asia director, Elaine Pearson, said “previous Thai governments have kept Uyghurs in inhumane detention for years.” (The Associated Press, November 4; Reuters, November 4; Amnesty International, November 4; Human Rights Watch, November 3)
